What is your question? If your friend has been arrested, he will likely find himself transferred to Immigration and Cudtoms Enforcement custody.

There is no question. Your friend may need to consult with both a criminal defense attorney and immigration attorney.

Your friend needs to get a criminal defense attorney as soon as possible. He will also need to consult with an immigration attorney. He has to show the immigration attorney his employment authorization card.

All hope is not lost. Have your friend speak with an immigration attorney as well as a DUI attorney. Some DUI attorneys have an immigration attorney they will bring in to advise your friend of any immigration consequences.

For a non-question, there are a lot of responses. Since your friend was released the next morning, it sounds like the sheriff's department in the county where he was arrested is complying with California State law and not informing ICE and released him because he would be eligible for release on OR but for being undocumented. While he may be undocumented, as of January 1, he can qualify to get a California driver's license if does not have any type of hold by DMV. It gets tricky if he has tickets and a conviction for a DUI, but it may be possible even if he gets convicted of a DUI to get a license in January. He will have to clear up the tickets, if he is convicted of a DUI, he will have to enroll in the DUI class, get a SR22, and if he has more than 4 points on his driving record, he will have a separate suspension of driving privileges independent of a DUI conviction. He should consult an experienced DUI attorney who can think things through to defend the DUI case, but also help guide him so he can obtain the ability to lawfully drive in January. He should also consult an experienced immigration attorney to advise him of the immigration consequences and whether he can become documented. Good Luck!
