My girlfriend is going through a 'nasty divorce' and her ex decided to post on Facebook explicit photos of her, order to embarrass her. He resides in Kentucky and she now lives in Indiana.

I am a little confused because the heading of the question implies that you are the ex-husband. I will presume it is a typo. While Kentucky does not presently have a revenge porn law, a person was prosecuted using other state laws in 2013. See the link below. Have your girlfriend call the police. Also have her screen shot everything from Facebook for proof and removal purposes. Then she needs to reverse image search the photographs to make sure he did not post them anywhere else. Last, and most important, have her notify her divorce lawyer IMMEDIATELY. I guarantee the family court handling this case will be furious. http://kellywarnerlaw.com/revenge-porn-laws-the-50-state-guide-updated-weekly/

It is possible that the person can be prosecuted, it depends on how the prosecutor out there is responding to revenge porn cases. I would suggest that she contact the police. Of course, she should also discuss this with her lawyer.
