I'm a green card holder last 6 years. Husband become citizen 3 years ago. I had a N-400 interview 2 days ago, at Newark. I passed civic test. Officer said he needs time for evaluate, then they updated my status "Request evidence" Why? I was violated my student visa back in 2002, My I-94 was D/S, I got married 2003, before my husband's green card application. Anyway, I heard from my old address they are looking for me, I left voluntarily in Jan-2008, without any removal process. Any deportation or hearing. We applied from my country embassy and I granted my green card 2008. I am very good standing alien and no criminal record, pay taxes,. I have 10 years old she is citizen too. What should I expect next? Can they deny my N-400 application. Please advice Thanks in advance

It is impossible to say what the problem is without seeing the request for evidence. Based on your facts, it is possible there is a fraud allegation relating to your obtaining permanent residence or a problem that you were not eligible to receive that status due to your prior violation. You need a lawyer. Now.

Whether or not your N-400 will be denied will depend on what evidence they are requesting and your response to it. Just wait for the Request for Evidence notice and respond to it accordingly.

At this juncture, it is hard to say what will happen. Once you get the Decision, you would want to consult with an attorney. Even better, you might want to consult with an attorney now in anticipation.

You are jumping the gun. If a request for evidence is issued, then wait for it and confirm what the query is. Ideally have it reviewed by an attorney.
