Can I sue my landlord for discrimination? I need a lawyer but financial issues keep causing me to go in circles. I NEED help...

Our landlord has repeatedly mocked and berated my partner and myself for having our disabilities. My partner has severe anxiety, especially when dealing with an aggressive and/or authoritative figure. I have a slew of problems, anxiety and tinnitus/Sensory Integration Disorder being at the top of the list. When asking her (the landlord) to lower her TV for my SID, she came upstairs and said I was being ridiculous. Mocked me, said "everyone has a disability" and laughed at me. This is not the first time she has berated us. She walks and talks all over us, treats us like children, and has reduced us both to crippling panic attacks more than once. She has alluded that she wouldn't have rented to us if she'd known of these issues, and is now trying to evict us for them. I need help. Please.

You may have a viable discrimination suit; it is hard to say. Much of it will depend on specifics--including what evidence is available. You will have to talk to an attorney, or to the MCAD. http://www.mass.gov/mcad/regs804cmr0200.html

The federal and state law provides for protection against discrimnination in housing. Secondly, you are entitled to what is known as "quiet enjoyment" of your tenancy. If your landlord is interfering with your "quiet enjoyment" then you may have a claim for violation of this right as well. Your landlord cannot evict you for disabilities and if she is attempting to do so, then you will have a strong case against her. She can evict you for non payment of rent or for no reason at all if you are a tenant at will. If an eviction proceeding has started then I would suggest you contact a lawyer experienced in landlord tenant law and get specific advise about your situation.
