MY boyfriend had an issue where he had gotten his license suspended and later re-instated. HE had hired a lawyer to help with the situation and the lawyer told him that he had it all taken care of. HIs cousin had been using his vehicle and had gotten a ticket and then a warrant. Last night they got pulled over and nonetheless the cousin got caught for a warrant and they also flagged his car with the warrant and the officer informed him that he had a warrant for this past offense and that his license was re suspended and a warrant was issued. what should he do since his lawyer told him that he had taken care of it already?

Speak with the old lawyer. See if he can figure out what happened. He may be willing to admit he made a mistake, if that is actually the problem, and tell the Judge and State that he was part of the problem. I'd at least speak with another attorney first and see if they can look into the situation to figure out what went wrong.

Sounds like he needs to speak with his lawyer about this. Maybe the warrant is unrelated to what the lawyer handled--although I know you desperately want to blame the lawyer.

Defendant should contact his former attorney to find out what happened. He can also call the court clerk to ask what happened and why the warrant was issued. In my experience, many people call me and complain about their former attorney when often, it turns out that they hired an attorney to get their tickets reduced to non-moving violations but then failed to pay the fines and court costs to the court. If you don't pay the fines and court costs (or complete traffic school, or provide proof of license reinstatement, or whatever else the court requires), the Prosecutor's offer of amendment will be withdrawn. In that type of situation, it's not the attorney's fault -- it's the defendant's fault for not following through and paying the fines. It's possible that your boyfriend didn't realize that the money he paid to the lawyer did not also cover the amount of the fines and court costs. No matter what, your boyfriend needs to get this taken care of, so if his former attorney is unable or unwilling to assist him, your boyfriend needs to hire an experienced traffic law attorney to take care of the warrant and tickets.

He needs to contact the lawyer who handled this initially. Apparently the lawyer did not do anything with regard to your boyfriend's cousin, and the warrant was still outstanding. If his cousin had a warrant, he likely had been cited for a criminal offense and failed to appear at a court date. Since he got arrested on the warrant, he now needs to have the criminal case handled. As for your boyfriend, if his license has been suspended again, he needs to find out why. Your boyfriend also needs to find out what offense the warrant is for and talk to the attorney to have him help him on it.
