How do I get the police report of my arrest?
Anonymous3 views4 answers
Hi, I was wondering how I go about obtaining the police report of my arrest. I want it so when consulting with a lawyer they could give me a more accurate idea of my defense without having to retain them first. I applied under OPRA, but was denied because the arrest report isn't covered. I didn't think it would be a problem because it is my arrest report. From what I read I need to file a motion for discovery, but I can't find anything definitive on it. Is there a special form I fill out? Any help would be appreciated.

The normal procedure is to consult with the attorney based on your version of events. The discovery will be sent to the attorney on letter request. If you send a "discovery" letter to the prosecutor yourself (some towns want the police records office to get the letter too) you will eventually get the report. You need to ask for all discovery and referrence Rule 7: 7-7. The time this takes will likely preclude retaining an attorney before the trial date. Catch 22.
Your question is about how to get discovery. Assuming you can get it, do you know how to: identify issues? which motions to file? how to file motions? how to prepare a defense for trial? or any of the myriad ways to defend yourself in court?
Asking those questions here will give you answers, but you won't know how to apply them.
Therefore, it would be best to hire an attorney even without the police report. It's a trust relationship, so hire someone you trust. Good luck.
you are entitled to the report. There is no reason that they should not give it to you unless there is something else regarding this case that you are not stating in your post. Perhaps you shouldn't state in your post and talk to an attorney first rather than setting forth any facts on a website that anyone can see..
