Can I file child abandonment on my sons father?
Anonymous3 views2 answers
My child is 8 years old. He hasn't seen his father but a handful of times and not since he was 2. He went to prison for 6 years. While in prison we were supposed to go to court for child support. The state said they would serve him when he got out. That hasn't happened. He hasn't had any contact with me or the child in 6 years and is now out of prison.
Hi! In Tennessee, abandonment can be proven with 4 consecutive months of minimal or no contact or financial support of the child. But a finding of abandonment can terminate parental rights which means no right to child support. So, your understanding of the long term consequences should be discussed with an attorney. PWK
You could very well try to terminate he is parental rights, especially if you have a new person in your life who would be willing to adopt.additionally, whether you attempt to terminate his rights, you definitely have the right to seek back child support. That may, in and of itself, scare him into cooperating with you. However, I would move quickly, because if he does reestablish contact, and start making any payments, it will keep you from being able to terminate his rights.
