Emailing a business in Canada and CASL

3 views 3 answers
I am looking to hire a freelancer located into Canada. Can I have have one of my employees randomly email a few different providers to see which freelancer is interested in my project? What I am confused about from my understanding CASL requires the person to opt in before contacting them. In my cases none of these people have ever opted in. Basically I am writing to say this is what I am working on would you like to get involved?

This is generally a question of Canadian law and cannot be answered on this site as emailing potential contractors in Canada subjects you to Canada's Anti-Spam Legislation, and thus Canadian law. However, your questions may be answered by looking at http://www.crtc.gc.ca/eng/com500/faq500.htm , or by speaking with a qualified Canadian attorney. Good luck!

I agree with Mr. Michels' comments. I would add that some Washington attorneys are experienced in international and cross-border transactions and may guide you through compliance requirements. A search on for international/Canadian attorneys would be a good starting point. Best of luck.
