What to do if petition I-130 denied?
Anonymous1 views3 answers
Hi, I married on USA citizen 5 years. Our case have been pending almost 5 years. Held interview on 25 August. Immigration intend to deny petition for alien relatives. That was a second petition already since 2010. What should I do?
The obvious question is whether you have done this all without a lawyer? Hopefully you are working with an attorney and it is just a difficult case. If not.... why not?
Consult with the attorney. Review why the immigration office intend to deny the petition. Address the immigration officer's concern and try to get it approved.
If USCIS has issued a notice of intent to deny, you should hire an immigration attorney (good one) immediately to respond why there were discrepancies at your interview and why you do not have the evidence that a couple for five years would have that would show you married in good faith. If you do not do this, the decision becomes final - and you would have to file a new I-130. However, USCIS may place you in removal proceedings if you do not seek help. You have a serious situation. Seek help from an attorney.
