Child Support Question-See below:

Child Support 6 views 2 answers
First question-does a cashed out 401K which was inherited and listed as income on federal tax return for 2013 factor into child support amount awarded by the court? If so, the amount of my monthly child support would increase from $437 to $1,540. Second question-would a judge (at a Masters hearing) allow the higher amount to stand? My wife's sister died leaving her an inheritance of about $100,000 most of which she cashed out from the 401K and banked. Third question-do I have any chance of getting the higher amount in your professional opinion and would the court consider it as income as the IRS has?

The court will sometimes spread that money out as income for the number of years that you would be eligible to receive or pay support. You should talk to a local family law attorney,so you can discuss the details of your case. Good luck!

These are all very good questions and all questions that should be addressed by a Pennsylvania attorney in a confidential setting. There will be other factors that will need to be addressed that would affect the answers. Hire an attorney and consult with that person.
