Scam/Fraud - TimeShare Resale - Type of lawyer needed to Sue company that made false promises?

4 views 2 answers
A company reached out to me saying that they had a guarantee buyer. After the transaction started I sent for different reason which according to them were needed $20K (I know.. very stupid of me). I have copy of all emails, documents that were signed, where it states that the money will be returning my funds since Easter. I recently found it that the transaction was not processed due to the cancellation fee not been sent. After I sent it, there was another fee from the escrow bank. I have not been able to get my funds until now. The money was wired to Mexico, the company is in the US in Quincy, MA. It is the most unprofessional company I have ever experience and I just want my money back. What are my next steps?

Sounds like you are the victim of a scam and fraud. The problem with pursuing the company is that if they are a fly by night business that does not live within the confines of the law, it will be difficult to impossible to recover any judgment you might get in court. Your documents might provide a choice of law forum where you would have to sue, and it might be Massachusetts. If it is not, you need an attorney who has handled real estate matters, specifically litigation regarding time share sales.

There are no easy ways of saying this, but your money is likely gone. Unless you identify an individual who was dealing with you through the entire transaction, you are left chasing a business entity that will never have the funds to repay you. And you are outside the small claims jurisdiction so you cannot keep their lawyers out of it. If you have some time to spare and the $300 in costs you will pay, file a limited jurisdiction collection action using Judicial council forms. Get a judgment, likely by default, and then see what kind of noise you can raise on blogs and other public forums. Your noise may get you paid.
