my friend was caught first for underage drinking, suggested to police i was involved. cops and assistant principle pulled me out, made me blow breathalyzer, blew .12. Sat in back of cop car till my dad came, took me home. Cop said it wont go on my record because I'm 17, didn't know the extents of my suspension, told my dad id get a citation.... did further reaserch, COUNTY policy states Alcohol (Includes wines, beer, non-alcoholic beer, and energy drinks containing alcohol)
1. Under the influence possession or use on school property, as defined above:
a. First Offense:
10 day suspension or 6 days if on a Condensed Academic Term
Required drug/alcohol counseling class"
What are the extents of the citation? what can be avoided legally? How much for a lawyer?
It depends on the county. In an area with no deferred programs, it could be problematic. Best to consult a lawyer. Many of us don't charge for an initial consultation, at which point you can request a quote.
You are facing criminal charges (citation) for underage possession of alcohol, most likely. That is different from the school suspension or discipline. Also, this WILL be on your record because you are an adult in the eyes of the law (since age 16). You will have to go to district court to face the alcohol charges. The school will let you know how long you will be suspended for. You should consult with an attorney because you may qualify for a deferred prosecution or community service agreement to get these charges dismissed.
