How to get divorce. Marriage less than 6 month.

I got married in July but i stopped living with my wife after a month. Now we haven't been living together for 3 month and both agreed to get divorce. What is the easiest and fastest way to get a divorce? or do we need to wait 6 month to file the uncontested divorce? Thank you

To file for an uncontested divorce under the "no-fault" grounds, you need to plead that the marriage has broken down for at least 6 months - and thus you'd need to be married more than 6 months in order to satisfy the grounds. Your other option is to file for an annulment. Schedule a consult with a Westchester Divorce attorney for a full assessment.

Not at all, you can file any time. You should contact an attorney that concentrates in this area if you want this done quickly. It is a specialized area of law and only an attorney practicing in matrimonial law will know how to expedite the process and file immediately. We have done many of these.

You can sue for divorce now if you can allege adultery. Otherwise, it would be easiest to wait and allege the no fault ground after 6 months. If you and your spouse agree, the divorce can be obtained on papers only, and there would be no need to actually set foot in the courthouse. Visit with an experienced family lawyer in your area to discuss options.

Notwithstanding the previous two answers: 1) The first question: how long have you lived in New York? If less than a year, stop... wait. 2) Fastest and easiest is to wait until the six month mark and file under irretrievable breakdown.
