Can I petition for adoption?

Child Custody 4 views 2 answers
In 2009 I was given permanent custody of my daughter because the mother is a drug addict and neglected her badly. I am not listed on her birth certificate but I do have a custody order from the state of OHIO and DNA stating that I am her father. I am currently married and I was living in Pennsylvania up until 4 months ago. For the past 3 years the mother has not paid child support, or attempted to have any contact with my daughter. My wife and I would like to petition for her adoption. Would we be able to do so in Ohio, and if so would de minimis contact apply concerning the mother?

You very well may be able to file to have a step parent adoption. You would have to reside in Ohio for a little bit longer. I would suggest retaining an attorney who can start processing the paperwork to adopt. It is a very paperwork intensive process. Good luck.

The non-existent contact with the mother will certainly help your cause; however, the Courts do not take adoption proceedings lightly, especially concerning the involuntary termination of a parental rights. Consult with an adoption attorney in your area for further assistance, and good luck.
