After probate is final how long does it take to get money?

My father passed on Nov. 13th 2008. We sold his house Dec. 28th of '09. My brother is the person dealing with the courts. He has told me that Tomorrow he will be ending it with probate. (paying the fees and final paperwork.) So how long after can he divide the monies? I ask because I am needing to sign for something soon and I am trying to figure out a date.

I believe I answered a very similar question for you earlier. In most cases, the estate cannot actually be closed until all distributions have been made. It is possible your brother is seeking court approval of his final account and distribution. Once that takes place, the distribution could be made almost immediately. It sounds like you and your brother are on good terms. I would just check with him, explain your situation, and see if he can give you a better idea when the money might be coming. James Frederick
