We believe that our homeowners are collecting rent from us but suspect they are not paying the monthly mortgage. We contacted title company and bank, the bank said the loan has just been sold again and are unable to get this information to us due to policy of not being able to give out this information
are there any other ways to get this information
is thier making loan payment public record anywhere before it goes into pre-foreclosure/ foreclosure?
You can contact a title company and ask for a current title report on your property, or get a lawyer who can access public records, but this will only tell you if the lender has recorded a Notice of Default, and not if payments are only a few months late.
Until a foreclosure actually happens, unless the lender exercises their right to collect rent, which is rare, the owner is still the owner, and has a fairly long time in which to reinstate the delinquent loan, if in fact it's deliquent, so tenants are still obligated to pay their rent.
