Wreck at a intersection both drivers claim the other ran the red light who is at fault?

I stopped at red light went when it turned green saw that car coming at me wasn't going to stop. I stopped in middle of intersection the other car didn't slow down hit the front passenger side of my car it spun his car the direction he was coming from it just pushed my car over angled a bit but tore off my bumper grille & radiator he said I ran the light but I didn't. The cop said he couldn't determine who ran the light, but said he could tell I stopped & the other car didn't. Who is at fault?

The person who ran the red light is at fault. Some intersections in Ft. Smith have cameras that record the traffic, but many are just traffic sensors. I agree with Christian, that you need somebody to investigate as soon as possible and see if there were any cameras that would have a view of the intersection. If there is no video evidence it does boil down to who is more credible. Given that you were stopped for the light already, that helps your case. I would also want to know which intersection. It also helps that you stopped, but that alone isn't enough to win your case.

If you stopped the other driver had the "last clear chance" even if the other driver did have the green. Point out to your insurance lighting, sight distances, color of your car etc. Any cameras at the intersection or businesses at the corner? Ask now as they can't store the images more than 3-4 days max. Good luck! And if you have injuries get to a doctor and also contact an attorney.

If you were injured, you should consult with a personal injury lawyer near you. If this is only a property damage claim, and you have collision insurance, turn the matter over to your insurance company. They will pay to fix your car, minus your deductible, and then go after the other driver's insurance.
