I am being sued for a car that tore up. I was buying the car.

I asked him to help a fix the car. He said if I still wanted my car to continue paying for it. So the car sat up in our yard for about 6 months after I made had stop making payments on it. He never came and got the car. So my husband loaded the car up on may 3, 2014 and took it to his lot.

Alabama's lemon law doesn't apply to used car sales. Pretty much, if you buy a used car, you are buying it 'as is.' Sometimes you can get a warranty that covers a used car, but it doesn't sound like you got one of those. Just because you took the car back to him doesn't mean you can get out of the car note. The seller may have taken the car and sold it...maybe for scrap. But he's going to come back after you for anything that's left to pay on the note...including interest and attorney fees probably.
