FL Lemon Law claim states the manufacturer must respond within 10 days from date received notification. They have contacted me via voicemail stating they have received my paperwork on 11/17 but I have not heard from anyone since. I purchased my new car in Apr, in May after it rained I could smell mildew. My car has been in and out of the dealership since then totaling 100 days to date. I opened a case in Sept with cust. care line and stated that as soon as I opened the door to the car after it has rained all I could smell was mildew. They have replaced the AC evaporator and everything was fixed so I was told until it rained again in Nov. My car has been in the shop since 11/10 the dealership has done everything they have been told to do and my car is still not fix. What is my next step?

This is a classic example of the type of case where you will likely need to spend the money to retain a lawyer to prosecute to make its handled properly now that it will likely be adversarial. Subjective issues in cars are every difficult to deal with under a lemon law basis. However, there have been a number of arbitration board cases recently awarding refunds to consumers with similar complaints about unbearable odor being found as viable non-conformity.

You have given the manufacturer enough time to fix it. There issue will be whether the defect is significant or not. You will need a lawyer and probably an expert in environmental factors to verify the contamination on the air of your car, which they can test for, then a appraiser expert to verify that with this odor the vehicle's value I=has significantly been impaired.
