In a recent program assigned by the president expanded DACA, an applicant born before june 15, 1981 qualifies so increased age upward of 31 y.o. limit. Is the prior 16 y.o. requirement extinguished? Under this guideline I think I qualified for this program however I came to this country with 28 y.o. in 1995 to a J-1 visa and on January 1, 2010 I have been living here since then. I also knew that singles over aged is out of the complete bill. I'm single and no kids. How to know if am qualified?

Good afternoon. I believe your question is whether a DACA applicant is still required to arrive prior to his/her 16th birthday (under the new guidelines). The answer remains "yes." Please see the attached link for confirmation. I'm sorry this isn't more helpful to you. But speak with an immigration attorney. You may have other options. http://www.uscis.gov/immigrationaction

The 31-year old age cap for DACA has been removed. You must have been present in the US on January 1, 2010 (instead of the original June 15, 2007) to qualify AND be under the age of 16 when you entered the US.

The first DACA required entry before 6/15/2007 and entry before age 16. The expanded DACA allows for a later entry date, but still requires entry before age 16.
