Anonymous4 views7 answers
I had a green light at the upon crossing an intersection.. and then a motorist attempted to to turn out of the intersection ,obstructing my right of way... I didn't have enough time to stop and tried to avoid hitting her but we still collided... so it resulted in my 94 GMC Sonoma to be totaled ....I did bump my knee which I felt on impact... im wondering do I have a case or should I just handle this through the insurance company ..?

Best to get your knee checked out, and if you sustained injury to it, retain a local personal injury lawyer. Otherwise, your insurance company can resolve the damage to your Sonoma. has a great lawyer finder tool to locate an attorney close to your home. Good luck.

Not quite sure what you are asking about handling through insurance company - property damage to your Sonoma or a potential personal injury claim. If property damage only, then yes you can usually handle those yourself, but with a 94 your insurer may ant to total your vehicle rather than try to repair it. If personal injury and your knee hurts, see a doctor sooner rather than later. Was there a citation issued for the accident? To who? Lots of unanswered questions, so consulting with a local personal injury attorney who offers free consultations is step in the right direction regardless of what you choose to do. Good luck.

I am sorry to hear of your recent collision. I agree with others who have said that you need to see a doctor and have your knee properly evaluated. If you have any significant injury, you should seek an attorney's help.

See a doctor TODAY (not soon but today - gaps in treatment are bad for you medically and hurt your claim) and if you're hurt see a lawyer. Do NOT talk to the insurer at all. If you do have a case, you'll get a far smaller settlement on your own than with counsel.

You should obtain needed medical care and treatment immediately and follow the doctor's advice. Do not give any statement to the adverse party or insurance company nor grant them access to any medical records. Photograph the injuries and the damage done to any property. Contact a personal injury attorney in your area as soon as possible so that you can protect your rights. You may also find it helpful to review the Legal Guides I have published on .com dealing with many of the issues you are now facing. The Guides can be accessed through my profile page on .com.

I agree with the answer of others, that you need to have a medical evaluation done. Very often the harm done by an impact isn’t felt immediately. This is why we caution people not to accept a quick settlement or to sign anything right away. Most people don’t have a lot of experience dealing with insurance adjusters, but personal injury lawyers do it all the time. I’d advise you to call a local attorney who offers a free initial consultation, take your medical records and the police report and find out whether legal representation can help you get a better outcome than going it alone.
