Child support modification
Anonymous2 views4 answers
Do I have grounds to modify a child support order? I never went to court. I never received any notices because unfortunately the mailboxes in my building constantly were broken into. I'm paying $730 monthly in child support. Medical insurance is provided through my job,and now my daughter is in college out of state, I'm supporting her,I also had to take a $15,000 parent plus loan out for her. Is this grounds to modify my child support order?
If you are paying for your daughter's room and board while she is in college, you can get a credit for these expenses out of the monthly amount of child support.
Based on the information you have provided you should be able to get a modification of the child support. If you are paying for her college room and board and tuition you should apply as soon as possible the modification once made will retroactively apply to the date that you filed the petition to modification. I advise that you hire an attorney to get this done at once.
Best of luck.
You might be able to get a downward modification however the entirety of your circumstances needs to be analyzed by an attorney in order to give you a better answer. You should contact one of the attorneys here on directly in order to schedule a confidential consultation.
You wouldn't have a basis to modify the order because you're providing additional, direct support to your daughter. You may have a basis to modify if you're contributing towards room-and-board. Schedule a consult with a Bronx Child Support attorney for a full assessment.
