Should I allow CPS to talk to my children and to come into my home?

Child Custody 4 views 1 answers
My ex wife called CPS because our son came back to her house and said that he was touched by my step son in the privates and that he also touched his. My wife and I have discussed this with both boys and have addressed the inappropriateness of this behavior. I feel this is misplaced curiosity on their part. (both boys are under 5 years old). A CPS worker showed up to my home yesterday and talked with my wife. She didn't ask many questions but did want to come back when the all the children were present to talk to them in our home. Nothing was said of an open investigation, nor did she seem concerned about that the children were unsafe at our home. Should I allow the woman to speak to our children in our home? Should I record the interview? Any advice would be helpful

If a CPS worker came to your home, it is highly unlikely that there is not an open investigation. She should have provided a document with information regarding the investigation when she visited your house. Based on the information you have provided, you should cooperate with the CPS worker. The best way to get the case resolved and determined to be unsubstantiated is to cooperate and answer the questions. You should allow her to speak with the children. I understand the frustration of having a CPS investigation when there has been no wrongdoing, however the best way to resolve it quickly is to work with the caseworker. If you are concerned that the caseworker may find that the allegations of abuse or neglect to be substantiated, consult a local attorney who specializes in these types of cases.
