If I was denied for LTD for a reason I am not filing for and probably was provided by the doctor who messes all paper work up...can I file with the new company my employer started us with dec 2014? I was on STD from the prior company. But since I am no longer receiving STD since the middle of Sept and they denied Oct to present can I try to file a new claim with the new company? Do I start with STD again? Or do I appeal the incorrect info on the denied claim with the old company? Or do I file a new claim with correct conditions with the old company? What a mess....Please any help would be appreciated.

That depends on the plan language. Your new policy will likely have preexisting condition checks. If you were denied, you should consider, first and foremost, appealing that decision. Invoking your new policy is likely only a last resort. This is what you should do. Take both policies and your denial letter, and contact an ERISA Disability attorney. The choices you make now will have significant consequences, get advised before you take any course of action. Best of luck.
