In a child custody case (child is 8) who decides when/if a parent needs a psychiatric evaluation and can my lawyer request one?

Child Custody 2 views 3 answers
As of this writing we are together but I do plan to leave. The father is power driven and very controlling of me and my daughter. I am afraid to file for custody because if he is awarded shared custody then I fear for my daughter's safety. There has been no physical violence to date but the mental cruelty towards both of us is taking a toll on my daughter.

If a parent does not voluntarily agree to an evaluation, you or your lawyer (if you are represented) would likely have to Motion the Court to order an evaluation.

Court would decide. You will probably have to pay for it. Consult your lawyer.

Of course I don't know the facts in your case, but I can tell you that is it not rare for one member of a couple to think the other one is crazy. An attorney will help you make the best use of a psychological evaluation, if one is ordered. Keep in mind that the judges have heard it all.
