Wrongly accused of domestic assault

Domestic Violence 6 views 4 answers
I was hit by my husband and called the police. I was obviously upset and crying when they arrived and he was calm and cool after getting his aggression out. I was floored when I was the one arrested. I later found out that he lied to the police about what happened and on his written statement. I tried to show the police medical documentation about him to support everything I was saying and would have refuted everything he said. They refused. The charges were non prosed, but I am psychologically damaged by this experience. Do I have any recourse against anyone? I am very angry and bitter about the experience and am divorcing my husband because of this. I am seeking counseling, but I think that there should be some thing I can do. Please help..

No, there is nothing you can do. You cannot sue the police for pursuing the investigation and arrest based on your husband's statements. You can divorce him and, if you wish, expunge the arrest record.

Your divorce attorney should be able to advise you on your options.

The police have a tough job and do a service to the community. You should not sue them and would not be successful if you did. The Commonwealth did all they could in agreeing to nol prosse the case. Your recourse is against your Husband in a divorce action. A good divorce attorney can advise you of your options. Good luck.
