Can I collect living expenses from someone who stayed with me and promised to pay when they got on their feet.

A friend called us late one night saying that her and her 2 teenage boys have nowhere to stay and that everything the have was taken from them ib a bad business deal and asked if they could stay with us. Upon her moving in she was very appreciative and promised to pay us back when her case settled and she was on her feet again. Since then she has not made any attempt to pay for anything which included all living expenses, food, and a place she could work to restart her business. She is now filing a complaint against me personally for something and I want know if I can file a counter complaint to collect back rent, food, utilities and any other expenses with a verbal agreement?

If you had a verbal agreement, yes, you can sue for breach of contract. However, it will likely be difficult proving the existence of this contract since it was strictly verbal.

You can sue for breach of an oral agreement. The Statute of Limitations is 2 years. What you must prove is not that you provided / paid living expenses, but that she made an agreement to pay you a specific amount at a specific time. If her statements were vague, you have a problem proving the terms of the agreement.

Yes you can sue for the breach of a verbal contract. I would suspect that given what you have stated, there will be mutual agreement of the facts, or at least many of them. Wining a case that involves a verbal agreement is absolutely possible. Clearly, your generosity is not being appreciated. You should consult with a local attorney who can review the lawsuit your "friend" filed and best advise as to how to reply.
