Was this age discrimination during a job interview?

2 views 3 answers
During a recent job interview for an accounting clerk for a property management company the interview stated that was a long time ago after I had stated that I had my son when living in a townhouse managed by this company. I found out today that I was not hired because I was too experienced. They decided to hire a more inexperienced person. Was I discriminated for my age. I'm 59 but was qualified for the position. They were hiring through a temp to hire basis, the temp agency informed me that I did a really good interview but I was too experienced.

This doesn't strike me as discrimination. If you think your age was the reason for not being hired you should consider contacting the Equal Employment Opportunity Commission. 216-522-2001.

That is not evidence of direct age discrimination. Discrimination cases are extremely difficult to win especially for cases arising out of the hiring process. It is very difficult to prove that a person was not offered a job because of age or "too much experience". The courts have routinely held that a business can hire a person who is cheaper which often is a result of having less experience. Plus it is difficult to determine how qualified or how well the other party interviewed.

Did they ask you your age during the interview? If they did, that could be some evidence that there may be age discrimination involved. However, you have not provided enough evidence to show any direct age discrimination. As pointed out by the other attorneys these cases are very hard to win, and courts routinely dismiss them when there is no direct evidence of age discrimination.
