State of residency suspended my drivers license almost 5 years after a "dui" that I got in another state. CAN I SUE

I got a DUI while stationed in Hawaii in Dec 2006. I satisfied everything needed in Jun 2009 for lack of misinformation and 2 deployments. Jan 2010 CA, I went to walkin court and I had 2 tickets, both over $1000. One ticket was thrown out because it was too old I guess, and I paid the other. Dmv gives me my license. I lose it 14 months later and go get a replacement and they tell me it was suspended for the DUI and I should have never got it back. I never received any mail 14months. Out of work that whole time, paying for the course, not being able to drive 50minutes out of town to get there or for work was impossible. 2hr roundtrip bus to work I have no time. I had the MONEY and TIME when I first went to court. Probably why I never got a security patrol driving job, my only experience

Can you sue? Well, you can sue a rock or a tree or the ocean if you want. The real question is will you win or will you get your license back by suing and the answer is no. Being able to drive is not a right. It is a privilege. It sounds like you need to make sure you really completed everything for your Hawaii DUI, then confirm there is no bench warrant there. Then confirm there are no bench warrants for you here in CA. Then confirm you have no ticket outstanding here in CA. Good luck.

I'm not sure who you would SUE, but I'm certain your lawsuit would be summarily dismissed.

Use your resources to find out why dmv has your live de suspended . There still could be axe arrant in HA. You might have otter warrants here.

Your California license should have been suspended when you got the DUI. You likely have a hold in Hawaii, therefore, contact Hawaii DMV and see what procedures you need to do to get the hold lifted. Indicate to them that you don't live in Hawaii and don't plan to drive there. You can't sue though. DMV holds you responsible for informing them about any DUI arrests.
