What should I write on my citizenship application about my careless driving case?

2 views 3 answers
I was involved in an accident in June. In August, the judge gave me a deferred sentence, with conditions that I supervise my driving for three months, pay an $80 fee and complete a driving course. I've done all of them, but my record is still on nmcourts.gov. Here are my questions: Do I automatically consider it as dismissed? Or should I wait for an order of dismissal? Should I say on my application that I was charged? Convicted? Is that considered a deferred adjudication? Will my record be erased or can it be expunged? And for immigration lawyers, especially: Will that hurt my chances of getting citizenship? It was an accident... Please help, anybody! And, FYI, I'm in New Mexico. Thanks so much!

What you need to do is: 1. Relax 2. hire an attorney to guide you through the process 3. Be aware of the fact that a record can not be expunged ... from an immigration stand-point.

You may have meant reckless driving and no a careless driving offense. Reckless driving is a criminal offense and not a mere violation, depending on your state law. Accordingly, I agree with my colleague that you must disclose it and have a certified copy of the court disposition submitted with your application. This conviction will be on your record for ever but should not preclude your naturalization process. Good luck!
