Is my employer allowed to just not pay my fringe benefits? (Health and welfare and pension)

Bankruptcy and Debt 3 views 2 answers
For the most of the year my employer has not paid into any of my fringe benefits, I was not provided with health insurance through them nor did they contribute towards my pension for the hours that I did work on prevailing wage jobs. When asking about these benefits I was told by upper management if I didn't like what was going on the doors right there you can leave at anytime. Basically telling me to be quite or I'll lose my job. What is my best recourse of action?

Contact your union representative. If you have no union, then read your employment contract. If you have no contract, you have no beef.

Clearly from the tone of your question you did have benefits offered to you at the time of your employment. Or at least you had the expectation of benefits. As such, your options depend on whether or not you wish to keep this job. Clearly if you stay and shut up, then the employer knows they can do this again, and again, and again, etc.etc.etc. How much fun will that be? However, if you do stay, and you do gripe, and you do file a complaint with the department of labor, DOL, and you do formally request in writing to your employer the benefits, then you have a case going forward for wrongful termination if they do in fact then fire you. But now, you would have Damages, etc.etc.
