Sometimes a pet food manufacturer in China puts melamine in dog and cat food, then tens of thousands of pets die horrible, agonizing deaths because they were poisoned and the owners wonder why the factory operators, trying to cut corners and lower their production costs, substituted melamine for protein. And then they wonder why all the people involved didn't get executed, except for 1.
Answer to your question is that in the U.S., businesses fail just like everywhere else. Just because a business failed does not mean that someone committed a crime.
I appreciate your frustration, but the issue is not that the businessman lost the money in a good faith attempt to make more, it is did the business man with the intent, steal the funds from unsuspecting persons? Then, yes, he should go to jail,
Because the businessman didn't "take" millions of money; that was lost due to circumstance. The thief took money that he knew did not belong to him for the purpose of depriving the rightful owner of it and using it for himself.
The two situations are diametrically opposite.
