Is my lawyer doing all he can in my son's case? Are there any other programs that could get him less time?

27 yr old male. plead guilty to burglary and conspiracy to burglary in 2006. served 4 years in a 2 -4 year sentence. 6 years probation. DUI 2011. theft from motor vehicle 2013. 11.5 -23 months work release. Did not return to work release and arrested for felony 3 escape. DA is asking for a 2 -4 year sentence-not willing to negotiate lesser charge. Our lawyer told son to plead guilty and take an open plea sentencing. His plan is to ask for RRRI. DA is insisting my son is Repeat felon status based on his prior record scores (she says is over 5). My son was on his way to police station when he was arrested. My son's reasons for not returning are concern for his son who was homeless at the time. He went looking for him the day he didn't return to the center. Lawyer- reasons don't matter.

Nobody here is in a position to evaluate another attorney's performance on a case.

A lawyer that doesn't have all the details can never judge another lawyer's work or effort. If you don't feel as though your son is getting the best possible representation, you have the right to hire a different attorney. Although I would point out, that your son isn't helping himself with getting himself arrested.

The attorneys who volunteer their time and advice on this site, do NOT do so for the purpose of second-guessing our colleagues. Moreover, if your son is represented by an attorney, we are prohibited from offering substantive advice regarding your son's case. Pose your questions to your son's attorney. If you are not satisfied with the responses, hire another attorney.

As stated by others, nobody can or will evaluate another attorney's performance based upon the limited information provided here. That being said, an attorney can work very hard in preparing a case, and still end up with a result that the client (or in this situation, a family member) does not like.
