What is sufficient as marked pleadings for the judge?

Business 3 views 5 answers
Is it acceptable to take a copy of the verified complaint that has been stamped filed by the clerk, write denied, admitted etc. (whatever the defense answered) in the left margin in black ink and submit that complaint along with the Answer as the marked pleadings? Or is there an additional verification, signature page or other information required?

Yes. When the Court says you are to provide marked pleadings, that is what is meant.

You understand perfectly the marked pleading requirements. Good luck with your case.

It sounds like what you are proposing should be sufficient for the court's purposes. You should attach a complete copy of the complaint (verification page and all).

Dear New York Plaintiff: That is "marked pleadings" described. Look at New York CPLR Section 4012: http://law.justia.com/codes/new-york/2012/cvp/article-40/r4012 ">>>Civil Practice Law and Rules: Rule 4012. Marked pleadings furnished. The party who has filed the note of issue shall furnish the judge who is to preside at the trial with copies of each pleading, where they have not been superseded by the pre-trial order, plainly marked to indicate which statements are admitted and which controverted by the responsive pleading.>>>" http://law.onecle.com/new-york/civil-practice-law-rules/CVP0R4012_4012.html

That is what marked pleadings are. I would include all the pages and I also give the Judge a copy of the Bill of Particulars.
