Excessive force used by Walmart AP, caused ER visit.

Business 8 views 8 answers
Walking out of walmart with groceries to go to the fireworks stand in the parking lot to pick some up for New Years. Upon walking past the first set of doors two large males grabbed me and slammed me into the wall, face first, and had me arrested for shop lifting. I went to the ER for multiple facial contusions as well and marks on both my arms. I never attempted to resist them and even agreed to walk to the back to review footage, which they never disclosed. The entire walk back the two males held my arms so tight they went numb and today, 5 days later, I still have bruising and headaches. They used excessive force and did not follow their AP-09 policy page AT ALL, never once telling me their names or identifying themselves. I have pictures & Medical records. I need to know the next step

You seem to have a good claim. Simply contact a few reputable personal injury lawyers in your state and see which one you will be more comfortable working with. They will take your case on "contingency, meaning it will not cost you a dime and the lawyer(s)/firm you settle for will obtain a percentage (negotiable!) of the final settlement you receive.

Step one, hire an experienced criminal defense lawyer to help with the criminal case. Step two, hire an experienced personal injury lawyer to help with your injury claim. It would benefit you to hire one law firm that can handle both aspects of your case.

As stated, deal with the criminal issues immediately and get a good criminal lawyer. Then get a good recommendation or use the search button here to call a couple reputable lawyers. Since it violates the rules of this forum to solicit you, and reputable lawyers are not likely to use this forum to try to get you in their door with solicitations to call, you need to make the effort. Finally, a violation of internal policy does not lead to a conclusion that it is negligence for which a company is liable.

Next step is to retain a lawyer that handles both criminal defense and personal injury to resolve both. has a great lawyer finder tool to locate an attorney. Good luck.

I am sorry to hear about this unfortunate incident. It sounds like you are in a great deal of pain and I'm sure this has taken a toll on you emotionally. As you inquired about the next step, I strongly urge you to speak to an experienced personal injury attorney who can begin handling and evaluating your claim. If Walmart has accepted liability, you may be entitled to compensation for (1) medical bills, (2) lost wages, (3) pain and suffering, (4) any permanent injury or disfigurement, and (5) inconvenience and loss of enjoyment of life. It is very important that you do not say or do anything that could jeopardize your claim. The goal of Walmart (or whatever entity is handling the claim) is to devalue your claim as much as possible. It is proven that they take your case more seriously when you have representation working on your behalf. It is great that you sought treatment with a medical facility as you stated. Any gap in treatment will be used against you when Walmart begins to evaluate your claim. Since you stated that you are still in pain, I encourage you to continue seeking medical treatment to address your injuries. Whenever you are involved in an incident, the first and most important consideration is getting whatever medical attention you need. If you do not have health insurance or the means to pay for medical care, a personal injury attorney may be able to help you see a local doctor. For example, I have relationships with several doctors in the Atlanta area and have been able to arrange for my clients to obtain medical treatment at no cost to them, with the understanding that the client will reimburse the treatment providers once the case settles or we win at trial. Due to the circumstances of this incident, you should speak with an experienced personal injury lawyer, who will be able to consider all the relevant facts and tell you what the case could be worth. In the mean time, please do not speak with Walmart or any of its affiliates, give a recorded statement, or fill out any correspondence that they send to you. Also, I strongly encourage you to review my legal guide, 'Five Things to Know if Your Are Injured at Wal-Mart.' I'm sure you will find it helpful. Good luck, and I hope you feel better soon.

You have a case. You will need the assistance of a good personal injury attorney with a sub specialty in this kind of bad conduct. Not every personal injury lawyer will have the specialized knowledge needed in your case. I would suggest immediately seeking a consult with an attorney to review the facts and law with you. The consultation should be free and likely any fee will be contingent upon a successful outcome. Best of luck to you.

You have what appears to be valid claims for at least false imprisonment, battery, and malicious prosecution. The next steps are to consult with a good law firm to assist in getting the criminal charges resolved in your favor, and to begin investigation into the incident for civil litigation. Find a few lawyers to consult with who have experience with these specific types of cases.
