I asked my lawyer to write demand letter to Ebay legal department before they ask collection agency to contact me so this way I can stop them any help apperciated
No one here knows what was said in the letter or how eBay will treat it. Considering the amount involved, they are likely going to proceed with legal action and make you put on a legal defense. As a collection attorney, purely for strategic value in a case like this, I would sue the person my client has the strongest contractual relationship with (the seller) and make that party drag the buyer into it.
I believe it would be best for you to follow the advice from your own personal Attorney rather than attempt to second guess him/her through a public forum. If you don't trust the advice you are getting from your Attorney, perhaps it is time to consult in person with alternative Counsel to address your legal needs. Before any Attorney can adequately respond to your question, they will need to evaluate the evidence you have alluded to in the query.
If they turn it over to third party collector then you know their priority is not to collect from you. Furthermore, once a third party collector gets involved and realizes your defenses and how there are substantial fact disputes, it might dissuade the collector from suing. Granted, we don't know how much money is at risk, and the larger the amount the more it makes it worth the collector to pursue. Sending a letter from an attorney with your evidence will only be helpful if it is to the entity that would likely be the one to initiate a lawsuit. As a collection attorney that is my two cents.
