How likely is it I would be able to recover fee's and collect on damages from a plumber?

We've been having the septic pumped every five years. After he came out and told us the field was bad we okayed the work. Two months later the tank was flooded. There was heavy rain, but history tells logic that this shouldn't have been this big of a problem. We had to hire another company to come pump it and it refilled within 15 minutes coming from the drain field, not the house. It's been a nightmare getting the plumber to come back to look at the problem and he seems reluctant to blame the obvious. Do I have grounds to take them to court for damages?

Can you possibly clarify the situation using the Additional Information section (not a comment on my response)? It sounds like the plumber told you there was a problem, but you agreed to have him do work anyway, then you had a problem like the plumber anticipated when there were heavy rains, and now you want to pin it on him. I have a feeling I'm missing something here.

On these facts you have not pinned anything on the plumber. Rain indeed can cause a flood
