"We started a business after we got married will my wife be able to get anything that was bought after we got married." Legal issues depend on FACTS, FACTS. Where did the money for the business come from? Her money or yours? Who worked in the business? You indicate, "We started a business...." That means you and her, right? Take a guess as to the likely answer when you use the word, WE, INSTEAD OF I OR ME? Unless of course there are facts that would counter that general conclusion. Facts, facts, facts, details, timeline, etc.etc.

Yes. This has nothing to do with your prenuptial agreement. That money was made while married.

The pre-nuptial covered stuff you brought into the marriage. What you have accumulated since is subject to division by the court. David

The answer to this question will depend on questions such as how long you have been married and whether you went back an amended your prenuptial agreement to cover the business. Also, did your prenuptial agreement cover after acquired property and interests? Some prenuptials do. Another attorney stated that cases such as these depend on facts and nothing could be more true. Is your divorce contested or uncontested? If it is uncontested, you, quite possibly, can negotiate most everything. If it is a contested divorce then it will depend on the evidence presented at trial. Good luck with everything!

It depends on the terms of your prenuptial agreement. There are ways to continue to maintain "separate" property after marriage. Everything will depend on the exact language of your agreement and the way the business was funded. Facts matter. You will need to contact an attorney and have them review your situation. The Judges in Tuscaloosa County are very accustomed to interpreting prenuptial agreements and I have no doubt they would strictly enforce the terms of the agreement. Good Luck.
