have been renting a home for 4 months now, when we first moved in the heater was not working and they management company sent someone out with no problem. Well the Thursday before Christmas the heater went out again (12/18/14), I text the manager late that night and advised this would be a issued because its cold in GA and its Christmas. He replied he would send someone out....Well the day after Monday after Christmas (12/29/14) someone finally came out, but advised they could not fix the issue because the wiring was not installed properly and the house would need to be rewired before it could be repaired. We call the management company again and they said they would send someone out. I have 2 small children and I'm pregnant and can not wait any longer...I voiced my concerned to the office manger on 12/31/14 and she advised she would contact be back in an hour. I still have not received and call from anyone. But they advised we must continue to pay rent. I cannot afford to pay rent and rent a hotel while they figure this out. what can I do....I would move but we put a 3K deposit down, can I sue and get my deposit back?

As a tenant when something breaks, such as the heater, you have two basic options: (1) pay for the repairs yourself and deduct the expense from future rent or (2) send written notice to the LL regarding the failure to repair that you are terminating the lease and move out. You owe the rent for the time you remain. Option one would not likely work in your situation. Your deposit money is not a ripe issue until after you move out.
