I need help with DUI and ignition interlock laws.

DUI 5 views 4 answers
I was convicted of a DUI last July. At the time, I was granted a restricted license with the provision that I install an ignition interlock device for the first 6 months. I have not been able to afford to do so up until this point and as such have refrained from driving. Because the 6 months has now passed, do I still need to get an ignition interlock device installed to be able to drive? Also, If I were to just not drive for the rest of my license suspension will I be able to have my license reinstated in July or will they still require me to have the device installed at that point? Thank you in advance for your help.

It has to be installed and used for a minimum of six months. Unfortunately because you asked for the restricted license that requirement is now with you until you do so. Even at the end of the year you cannot get your license back without six months of interlock first. A lawyer may be able to petition the judge to "remove" the approval of your restricted license, make it a 12 month hard loss, and at the end of the year you can get your full license back. But that is not guaranteed and if you could afford the lawyer you could afford the interlock.

Dear Fredericksburg - The judges want you to have to pass the IID for six months while you are driving - they do not just want you to wait six months before you start to drive without the IID. Good luck.

I would suggest you reach out to your attorney at the time of your conviction. They may have additional experience with the local ASAP organization, local courts, and local procedure. Though ASAP may have no choice but to require IID as part of "compliance" pursuant to their rules, you may have alternatives. You definitely SHOULD NOT be driving without interlock if it has been more than 30 days since your restricted license was issued.
