Can I sue the car manufacturer for the injuries that I sustained in an accident due to the airbag not deploying?

I was involved in a single car collision on 9/1/2014. I hit a curb then collided with a tree in a grassy area. When the car impacted the curb, my head hit the steering wheel and my girlfriends head hit the dash. We had our seat belts on but no airbags in the car deployed. Since that time I have had severe headaches and memory issues. Do I have a case?

You might not have to sue the car company to collect money for your injuries.

You might and should find a personal injury attorney immediately. In addition, preserve your car. Don't get any repairs done nor alter it in any way until you've talked to a lawyer. You may need an expert review of the air bag and don't want the car altered.

You and your girlfriend may have a claim against the car manufacturer depending on the severity of your injuries. Your girlfriend has a claim against you ( insurance company) for her personal injury. Best to consult with a personal injury lawyer in your area.

It is extremely costly to pursue a case against a automobile manufacturer. You may have a personal injury case depending on the cause of the crash. I would recommended checking to see if your specific car has been part of a major vehicle recall.
