Hello, I'm from different country, I'm gonna marry with an american citizen and my question is if i want to apply for green card there will be any problem in getting it, since my future spouse dont have a clean record, i mean is something minor like getting caught to have drink or drugs and spending 2 days in jail. Thank you

The convictions (drinking/drugs) of your U.S. citizen spouse will not have an impact on your quest for U.S. resident status.

Since it is you and not the US citizen who will be seeking a marriage-based green card and not the other way around, the relatively minor running-ins with the law and/or convictions of your future USC spouse will have no impact on your being able to obtain a Green Card.

Thank you for your question. It is a common one. No, immigration will not ask questions about your US citizen spouse's criminal history. However, they will ask questions about yours.

Before you initiate anything I suggest your fiancée visits a local office of a reputable immigration attorney to make a road map, although her prior history as stated will not affect the filing.
