Is there any recourse for my attorney not redacting my social security number from recorded documents?

Business 2 views 2 answers
During my divorce proceedings, I became pregnant with my son, and my now boyfriend is the father. Due to the state laws, I couldn't get divorced until the baby was born and the father signed a paternity affidavit. I obtained the paternity affidavit from the health department and gave to my attorney. He did not redact my social security number, nor did he redact my boyfriend's social either. This affidavit has been recorded into public documents with my decree, and now my ex has a copy of both of our social security numbers. I know that redaction is required in the state of Indiana. What is my recourse now that our social security numbers are out there for anyone who wants them??

Take this issue up with your attorney. Have your attorney contact the Health Department directly, and find out first whether they redacted the SS numbers; often, agencies will (or are required to) do this on their own. The agency also needs to take some responsibility for this if they recorded a document with your Social Security numbers on it. If they did not redact the numbers, your attorney needs to find out from the Health Department what procedure you can follow to have the numbers redacted. Your attorney is responsible for knowing the law, and should fix this issue for you, particularly if he/she made the error.
