Married in Florida for 4 2/3 yrs. No children together. Purchased a home together, housing market in the tank, can't sell for what is owed. If he stays in the house am I entiled to monies now or do I have to wait until the house is sold? Also is it better to stay in the house until papers are filed and or finanized? Any advantage to not moving out before any papers are filed.

Yes, there can be significant advantages to not moving out until the divorce is finalized and you are entitled to stay in the home whether you are the wife or husband. Are you the wife or husband? It makes a difference in terms of the advice given, particularly depending on the personality type of your spouse. You may be a good candidate for an uncontested divorce (which will cost much less in terms of time and money). You can always contact my office for a free consultation if you would like. If you are looking to file without legal representation ("pro se") you can get a forms package at the office of the Clerk of Court.
