I was driving down a two lane street and driving the speed limit. A car was attempting to pull out of a restaurant driveway .

The car was halfway in the middle of the road and attempting to try to find an opening. He had no turn signal on, and was half out in the street and half in the parking lot. He was completely stopped. I went around the front of the car with no problems and beeped my horn to let him know he was putting lives in danger. He then pulls out and hit my passenger rear door with his truck. He hit me, and had no damage to his vehicle. Who is at fault?

The driver entering the roadway is at fault. He has to yield to all oncoming traffic. You did not indicate if you were injured. You should speak with a personal injury attorney to find out what your rights are under the specific circumstances of your case. Best of Luck.

From what you have described he is at fault. He as a duty to pull out into traffic safely. While coming out of a parking lot onto a roadway he must stop before entering the roadway and only enter when it is safe to do so.

I believe the other vehicle is at fault. Give the claim to your insurance company and let them handle it.
