I hold a Class A CDL and have applied for numerous commercial driving positions , I have had no response and assume it is due to my DUI. I have a clean record since 2005.

Yes, you are eligible to apply for an expungement. The new law that took effect on Jan. 1 of this year is quite favorable to people wanting to apply. I'd contact an attorney as soon as possible, a successful process will take 3-4 months so starting now is in your best interest professionally. If you need an attorney you can search on this site or you can click on the profiles of an attorney you'd like to contact.

It's theoretically possible. Many judges and lawyers would say no, it's absolutely impossible to expunge a DWI. However, the new law doesn't include an exclusion for DWIs. So, it's an open question. Would be an uphill battle, but might be worth a shot.

According to the new law that took affect January 1st, it is possible to expunge DUIs. That being said, there is currently no meaningful way to expunge these from your driving record at this time. Many criminal attorneys offer free consultations and would be happy to speak to you more in-depth about your options.

I agree with all prior posts. The new expungement law offers hope to your cause but it is certainly not set in stone by any means. You should definitely give it a shot with the understanding it will be a new road to hoe.

The only thing I would add to the above answers is that I suspect the loophole that allows for expungement of DWIs will be closed by the legislature in the near future. While the odds expungement now are poor, I suspect in the near future, they will be nil.
