My husband filed the divorce complaint before I, we both obtained legal counsel, My attorney quit because he took a job with a private company and no one else in the firm handled these cases, My husband fired his attorney because he did not want to pay him anymore. The judge had said in one of our hearings in Dec that my husband needs to be ready to represent himself or he would throw the case out. My question is this, Should I hire another attorney for our last hearing which is coming up quickly, I just don't want to put money out if the judge is going to throw it out due to my ex not being prepared or having an attorney.....Should I wait then file myself ?

In my opinion it would be a waste of time to wait since there's already a case pending. You don' t say if you have a counterclaim filed. If not, you should get one filed. You'll probably need what is called leave of court to file it, but do it now. The same rule would then apply to you. If you do not have an attorney, you would have to prepared to go forward or as the judge told your husband, your case could end up thrown out as well. Therefore, you wouldn't be wasting money by getting an attorney now. At a minimum, even though it sounds like you are going to get an attorney later, have a consultation immediately. The other thing to keep in mind, your husband may show up with an attorney or be able to present it himself, in which case you would have to go forward on your own. Speak to someone tomorrow. Best to you, Lee

Hire an attorney and be prepared to file your own action, if the Court does not allow the action to continue.
