After the divorce I was awarded half of the house in Florida which my ex wanted for himself as a vacation home. I did not find out about the house until I had to sign the loan. He has now moved out of the house and is demanding I make the mortgage pmts. I live in Illinois, and was awarded half of our marital assets which have now disappeared and he was found in court to be hiding marital assets. He has thus filed an appeal to take away what was awarded to me and I basically I have nothing. He continues to me harass me with emails that I need to be paying him but he never allowed me to have much money. He is supposed to pay support but he finds misc items to deduct from it and it comes to next to nothing. He is American living in Bahrain and now says he does not have a residence.
Your inquiry is far too complex to answer in this simple online forum. You need to rteturn to your former attorney or consult with one or more new ones and hire the one you like the best.
there is no question. there is a recitation of upsetting facts.
if you were awarded half the fla house, how is it that you did not know about it until you had to sign the loan? was that after the divorce? but if you signed the loan before the divorce, then you knew about the house at the divorce. this is confusing at best.
if you signed the note and mortgage, you are liable to the bank for the payments as is he. if he is in bahrain, getting compliance with the divorce will be almost impossible.
how and when did the marital assets disappear? why did you and your lawyer let that happen? to where did they go? who did it?
if he has filed an appeal, then you need an appellate lawyer to represent you there.
he may not legally deduct items from support. if he has income from a company or entity in the usa, then you can do a notice to withhold income for support.
you desperately need a lawyer to deal with this rather than posting here.
What does your divorce judgment say about who is responsible for paying the mortgage? That should answer your question about who is responsible for paying. It is impossible to answer all the questions you posed on . I strongly suggest that you consult with an attorney in your area. Many attorneys do not charge for initial consultations with prospective clients.
Please consult qualified attorneys in your area, and hire the one who listens to you, seems to understand what you are communicating, and with whom you have the rapport necessary to form a competent team. From your inquiry, I sense that you are bullied by your former husband, and that you are allowing too much direct communication with him, rather than protecting yourself through a qualified attorney. Your issues are complicated and a good attorney will help you navigate through the situation.
Ask your divorce attorney to sort out the jumble of information you have provided. There is no way to advise you competently based on what you have written.
Your attorney (you'd better have one) can mount evidence to challenge this approach. Move on this quickly. Surely you know this is not a do it yourself project
