My child is 22 but I am still making arrears payments. Can I petition Illinois to obtain a passport? What is the process?

You would only have to petition the court if there is an order denying you a passport that has been certified by the Secretary of HHS after Illinois notifies them. Have you tried to get a passport and been told you are denied on the basis of child support arrearage over $2,500? If so, you must petition the court. Find an experienced family law attorney to help you with this if you have to file a petition.

go apply for a passport. if it is rejected due to the support arrearage, then do a petition to ask the judge to permit you to get a passport.

Persons who owe child support debts greater than $2,500 will be sent a passport denial after which you'd have to Petition the court for an order. Hire counsel for this dispute.
