I live in Chicago and My dad lives in Michigan. I want him to buy me a property in Michigan. Does he have to sign his acceptance of the POA in Chicago before a notary Public???
What do I need to do??
For dealing with a Michigan property purchase, I suggest inquiring there with an attorney or title company. The process is likely to be made easier using their expected forms, rather than an out-of-state form. Once prepared, you can sign and have the Form witnessed and notarized here as may be necessary.
I agree with the other answers. If you read them together, I suggest you find out the forms MI accepts as each state has their own forms and procedures, and then you sign before a notary in IL and your father signs before a notary in MI. That should give your father the proper authority to complete a purchase for you. In addition, you should review all documents he is to sign prior to him signing anything. You need to be involved even if your father is signing everything.
You may sign the Power of Attorney form in Illinois before an Illinois notary public and another witness, and your father may sign his acceptance of authority to serve as your agent in Michigan before a Michigan notary public.
Each state recognizes notary acts performed in other states pursuant to the Full Faith and Credit clause of the Constitution. There is no need for your father to travel to Illinois for this purpose.
You didn't state whether this will be a cash purchase or not. If financing is involved, the lender may not accept a power of attorney for the mortgage documents. If it's a cash purchase, I believe you can either use a Michigan power of attorney, or simply have your dad purchase the property in your name. He should retain a Michigan attorney to handle the transaction and he or she will be able to guide him.
